Development Regulations
7.1 Applicability
Development and construction except as herein after otherwise provided,
these regulations shall apply to
(i) All development in the Planning Area designated by SADA
(ii) Making any material change in land and includes subdivision
of land and use of land in terms of occupancy.
(iii) The corporate development inclusive of group housing projects.
(iv) Any type of building including inclusive height of building
etc.
(v) Development of land, construction/alteration, demolition of
building in areas beyond Municipal area but with in the Planning
area.
7.2 Jurisdiction
The development regulations prescribed in this chapter shall be
applicable within the planning Area delineated by the State Govt.
u/s 13 (1) of the M.P. Nager Tatha Gram Nivesh Adhiniyam 1973 vide
Notification No 282/F-1-7/XXIII-/74/Bhopal dated 24.6.74 and the
amendments affected in sect. 13 of the Act published vide Gazette
notification dated 27th July 1995. Norms and regulations which are
not specified in this chapter, in such matters the provisions those
contained in Madhya Pradesh Bhoomi Vikas Adhiniyam 1984 shall be
applicable.
There is a possibility that the proposals indicated in the Development
Plan in respect of circulation, use zone delineation may need modification
based on the engineering requirements for implementation. The decision
of the State Govt. in respect of such modification shall be final
and shall be considered as a part of the plan proposals.
The proposals indicated in the Development Plan are indicative and
broad in nature to provide for the contents of section 17 of the
Act. The residential Zone. For instance indicated in the Development
Plan map embodies the inherent provision for internal roads, open
and green spaces, essential areas for education and health facilities,
utilities and services and unusable land in shape of cut up land
existing vegetation. The locations and area spread of such provisions
in residential zone are therefore not shown in the map.
The structures permitted by the competent authority that are existing
in any use zone are proposed to be retained in its present form
and for the use the structures are used at present.
The map of Development Plan report is not to be used for calculation
of areas and linear measurements. Such exercise shall be conducted
on actual survey map on a scale of 1:3600 with due rectification
on revenue map on a scale of 1:3600.
The agencies identified by the State Govt. shall continue to undertake
preparation of zoning plans as a continuous process.
Approval granted to layout plans, by the competent authority under
either M.P. Nager Tatha Gram Nivesh Adhiniyam, 1973 or recommended
for diversion u/s 172 of MPLRC by Joint Director, Town & Country
Planning, Gwalior region and if its validity still holds good on
the day of publication of this Development Plan, shall be deemed
to have been approved in conformity with the development plan proposals.
Under exceptional circumstances involving public purpose, the State
Government, involving developments of National, State level and
city level activities benefiting the city population collectively
could grant development permission. However the recreational areas
indicated in the development plan shall not be permitted for change
of use under any circumstances.
Any structure or activity connected with utility infrastructure
shall be permissible in any of the use zone as per requirement of
site and utility infrastructure planning and design duly approved
by the competent authority.
In specific areas where certain restrictions are to be imposed from
security angle, the State Govt. will be competent to pass such orders,
in consultations with the Home Department.
In case some corrections in the drawings submitted for approval
are found essential, the sanctioning authority should mark all such
corrections and return the drawings for re-submission duly corrected.
The approval shall be recorded on the corrected drawings.
The layouts of the plots, buildings and any other new structures
built after within the planning area shall conform to the norms
laid out under the “The persons with Disabilities (Equal Opportunities,
Protection of Rights and Full Participation) Act, 1995. Sections
44,45 and 46 of the said Act are relevant in this regard :
(i) Non discrimination in transport - Establishment in the transport
sector shall, within the limits of their of their economic capacity
and development for the benefit of persons with disabilities, take
special measures to -
(b) adapt toilets in rail compartments, vessels, aircraft and waiting
rooms in such a way as to permit the wheel chair users to use them
conveniently.
(ii) Non Discrimination on the road - The appropriate Governments
and the local authorities shall, within the limits of their economic
capacity and development, provide for -
(a) Installation of auditory signals at red lights in the public
road for the benefit of persons with visually handicap;
(b) Causing curb cuts and slopes to be made in pavements for the
easy access of wheel chair users;
(c) Engraving on the surface of the zebra crossing for the blind
or for persons with low vision;
(d) Engraving on the edges of railway platforms for the blind or
for persons with low vision;
(e) Devising appropriate symbols of disability;
(f) Warning signals at appropriate places;
(iii) Non - discrimination in the built environment - The appropriate
Governments and the local authorities shall, within the limits of
their economic capacity and development, provide for -
(a) Ramps in public buildings;
(b) adaption of toilets for wheel chair users;
(c) braille symbols and auditory signals in elevators or lifts;
(d) Ramps in hospitals primary health centres and other medical
care and rehabilitation
institutions.
7.5 Sub-Division of Use Zones into Use Premises
The objective of these regulations is to guide the preparation of
layout plans for different use zones. These regulations also include
norms for provision of facilities and circulation system. The service
plans corresponding to these layout plans for provision of physical
infrastructure like water supply, sewerage, drainage, etc. shall
conform to municipal bye-laws.
Use Zone : Residential
Plotted Residential
The width of plot and depth of plot, preferably shall be in a ratio
1:1.5 or 1:2 or maximum up to 1:3.
The norms for residential development in respect to plot sizes,
type of plot, FAR, Ground coverage, height of building and permissible
dwelling units are required by the builders/architects to conceive
their building plans. The schedule of coverage and set backs for
residential areas are given in Table no. 7.6-1. The plot sizes indicated
in the table must be a part of approved layout and site be fully
developed for grant of building permission.
The layout (in new areas) designed to accommodate more than 4 units
in one plot shall be permitted provided adequate provisions are
made for water supply, sewerage, parking facilities and are physically
ensured while ground floor is under construction.
The area developed as plotted development situated in the existing
developed areas, fully or partially developed, at present identified
as family/joint family unit may be permitted for conversion as multi
unit plotted development construction only after augmentation of
utility and services are ensured.
The State Govt. has issued circular for reservation of 15% area
for informal sector of the society. The minimum area of layout for
such reservation is 4000 sq. m. 15% area of the total area of layout
above 4000 sq. m. shall have to be reserved for providing for providing
housing site/dwellings to the informal sector of the society.
The layouts, exclusively for low income group shall be prepared
as per the requirements of Appendix-M (Rule 94) of Madhya Pradesh
Bhoomi Vikas Rules 1984. The Table 7.6-1 Provides for additional
categories of developed plots.

The plots either regular or irregular having area, between the ranges
indicated in the table, shall be permitted with MOS, coverage, FAR
of the earlier category or as designated in the planning permissions.
Covered parking in group housing if provided on ground floor, within
the permissible ground coverage, shall not be counted in FAR.
The maximum height of the building shall not be more than 12 m.
In case the ground floor is used for covered parking the maximum
height of the building shall be 14.5 m.
No. of dwelling units on a plot designated for a family/joint family,
shall not exceed more than 4 dwelling units per plot.
The basement shall be permitted under the ground floor and maximum
to the extent of ground coverage and shall not be counted in FAR.
For plots above 250 sq. m. and upto 500 sq. m., maximum of 1 servant
quarter and for plots above 500 sq. m, maximum of 2 servant quarters
shall be permitted, in addition to FAR stipulated.
Each servant quarter shall comprise of one habitable room of area
not less than 11 sq. m. floor
area. Exclusive of cooking verandah, bathroom and lavotory. The
maximum size of servant quarter shall
be 20 sq. m.
For the purpose of density calculations the dwelling unit shall
be considered to accommodate 4.8 persons and the servant quarters
to accommodate 2.4 persons.
For plots above 288 sq. m parking provision shall be provided @
1 car space per 240 sq. m of permissible built floor area. The covered
parking area shall be excluded in FAR. But in case of multiunit
plotted development parking has to be provided.
Plot size less than 32 sq. m shall be permitted in case of resettlement
of Jhuggi dwellers.
GROUP HOUSING
Group Housing schemes shall be governed by the following norms :
A. The minimum size of the site for this type of development shall
be 5000 sq. m.
B. This 5000 sq. m size must form part of approved layout plan,
in which the city level circulation is co-ordinated, essential provision
for sector/Sub sector level amenities, facilities, utilities and
services and provision for informal sector is ensured.
C. The ground coverage shall not exceed 33-1/3% of the area of site.
D. The maximum height of the building shall not be more than 12
metres. In case the ground floor is used for covered parking the
max, height of the building shall be 14.5 m.
E. Min. width of Road abutting such site shall not be less than
24m.
F. Marginal open spaces for such development shall be as given below
:
Front : 6.0 m minimum
Sides : 4.5 minimum
Back : 4.5 m minimum
G. Maximum height shall be preferred as 12 m
H. FAR shall be 125 maximum
I. Average DU size and No. of DUs to be calculated as per Rule 82
of M.P. Bhoomi Vikas Niyam 1984.
HIGH RISE MULTI UNIT CONSTRUCTION
The norms for such development shall be as follows -
A building structure which is having more than 12m height will be
termed as high rise Building.
This type of development have different character.
(i) Plot size : Not less than 2000 sq. m
(ii) Width of the plot along the road - 30 m minimum
(iii) Minimum width of the road : through out not less than 30 m
(iv) Front setback : Min 1/2 of the height of the proposed building
(v) Side and rear setback : Min. 6 metres
(vi) M.O.S. will be kept free from all obstacles to allow free movement
of fire fighting vehicles.
(vii) FAR allowable 2. 5 maximum.
(viii) Car parking, provision to be made according to Table 4.T-18
(ix) Structural design, fire fighting equipments and its provision,
water supply, sewage disposal arrangement will be followed as per
provisions of the M.P. Bhumi Vikas Niyam 1984.
(x) Permission of high rise building will be obtained first from
the committee appointed under Niyam 14 of Bhumi Vikas Niyam 1984,
then the approval can be obtained from the competent authority having
jurisdiction of the building erection.
(xi) For building in the vicinity of aerodromes the max. height
of the building shall be governed by the norms of Airport Authority.
(xii) These provisions are for all categories of uses and not with
standing any provision in any specified use in any zone, if the
height exceed 12 mertes. (Refer M.P. Bhumi Vikas Niyam 1984).
CLUSTER COURT HOUSING
Minimum Size of Plot : 4000 sq. m
Maximum FAR : 100
Maximum height for plots up to 45 sq. m : 8 mts (2 storey) with
max. cov. 100% subject to light and ventilation condition.
For plots above 45 sq. m : 11 mts (3 storey) with max. cov. 100%
subject to light and ventilation condition
Other Controls
(i) The net housing density permissible 140 DUs per Hact with a
15% variation on either side and could be averaged for more than
one pocket.
(ii) Minimum street front of the pocket : 20 mts
(iii) No basement is allowed
(iv) No projection outside the building envelope
(v) Each cluster court house is for one dwelling for a single family
(maximum 6 persons)
(vi) Setbacks for the pocket would be the same as below :

(iii) No dwelling units should be built within 400m of the right
of way of National Highway.
Mixed use regulations
(Non-residential activity on residential premises)
Mixed use here, essentially means permission of non-residential
activity on residential plot or residential flat.
At the time of preparation of Zonal (divisional) plans, in residential
plotted development in areas other than the old city and other urban
renewal areas; streets of mixed used activity shall be identified
:
1. Conducting a traffic study in each individual case to see whether
after permission of mixed traffic circulations in the area/street
and it would be built to take additional traffic which is likely
to be enerated because of the mixed use.
2. By evaluation of its impact on the municipal services and environmental
needs of the area. As part of the traffic study, the traffic study,
management solutions like traffic free pedestrianised streets/areas
and one way traffic etc. could also be considered for introduction
as a solution to the traffic/parking problem of the area.
In case it is found feasible to permit mixed used in a street/area
the same would be subject to the following conditions.
1. The commercial activity allowed shall be only on the ground floor
to the extent of 25% or 50 sq. m. whichever is less.
2. The following activities shall not be allowed.
(a) -building materials (timber, timber products, marble, iron and
steel and sand)
Firewood, Coal
(b) Repair Shops - Automobiles repairs and workshops.
(c) Service Shops - Four mills (more than 7.5 K.W. power load)-
Fabrication and welding
(d) Storage, godown and warehousing.
(e) Manufacturing units (excluding household industry).
(f) Junk Shop.
The front setbacks for these plots shall be surrendered without
compensation unconditional to the local body for use as part of
the right of way, parking etc.
A layout plan for the area shall be prepared indicating
(a) parking as per standard
(b) public convenience
(c) landscaping
(d) road carriage ways as prescribed, for approval of the competent
authority.
Because of the conversation of use activity the conversion fee shall
be charged from the beneficiary. This would be based on -
1. the cost or provision of parking and physical and social infrastructure.
2. different price of space of the residential and non-residential
activity/use.
INTENDED MIXED LANDUSE
At the time of preparation of layout of residential area, at suitable
location, clusters of plots shall be specify reserved for intended
mixed use for shops and household industries at the ground floor
and the residence on first floor and above. The buildings shall
be permitted on the plot as per residential-plotted regulations.

Institutional landuse for educational activities :
Educational institutions along with essential staff housing shall
be permitted in agricultural zone, on both sides of the regional
roads, An area of 100 metres from the edge of the right of way shall
be permitted for such institutional use. Such use shall be permissible
up to a distance of 1 km. from the outer ring roads proposed in
Gwalior plan 2005. The permissible ground coverage and FAR shall
be same as provided in Development Control Rules.
A strip of 10 m width between the edge of the proposed right of
way of regional road and the proposed use premises shall be reserved
for tree plantation.

(A) Procedure to seek Development/Planning permission
Any applicant willing to seek the permission under the provision
of the Development Plan following documents are required with application
under the provision of the Act. Annexure I (a) and I (b).
(1) The application for the above permission should be submitted
on prescribed form permission under sub section 1 of the Act.
(2) Ownership Document : Khasra Panchsala, khasra khatauni, Registry,
Namantaran of the land under question.
(3) Exemption of land from Urban land ceiling authority under the
provision of Urban ceiling Act 1976.
(4) Document supporting the provision under M.P. Vinirdisht Bhrasta
Acharan Nivaran Adhiniyam 1984.
(5) Description of land (Location with name of road/roads on/off
which the property abuts and boundaries.
(6) Khasra plan in original showing numbers of land in question
and also adjoining Khasras falling within 200 metres from the outer
limit of the land. The land in question shall be shown in red on
Khasra map.
(7) In case of built area plot number with approval part layout,
with details of approved layout.
(8) Location plan indicating the land in question, main approach
road, important building and the existing uses surrounding the land.
(9) Survey plan to a scale of 1:500/1000/2000 showing the boundaries
of land in question, natural features like hallah, ponds, hillocks,
trees, contour plans if the land is undulated, high tension passing
through or adjoining land up to distance of 200-500 mts., Existing
roads showing the right of way. Position of electric and telephone
pools trees and all other matters with needs to be co-ordinated
with the adjoining areas.
(10) Plan showing all development proposals with respect to the
land in question with a general report. A plan showing details of
utilities and services which is to be co-ordinated with the proposals
of development. The plan of services and utilities must be co-ordinated
with the adjoining areas. A model of proposal may be submitted to
make the scheme self explanatory.
(11) Architectural detail of the building for proper scrutiny of
the proposal.
(12) A report on type of development proposal viz. - residential,
commercial, inddustrial etc.
(13) Fees for development/planning permission shall be deposited
as per provisions of M.P. Bhumi Vikas Niyam 1984, the challan of
the fees submitted under the prescribed head should be accompanied
with the application for permission.
(14) Any other document/provisions under the provisions of the act
circulars issued by the government under the provisions of the Act,
shall be accompanied with the application and proposals of the development
of the land in question.
(15) Proposal of the Development Plan on the land in question under
provision of the Rule 49(3) of MPBVN 1984 shall be obtained and
accompanied with the application of development permission.
(16) Besides the normal which area submitted for planning permission,
a proper landscape plan, a circulating plan indicating vehicular
and Urban Design Scheme where necessary shall be submitted duly
signed by their authorized Architect/Engineer/Planner.
NOTE :
(1) Directives and instructions issued by the Government time to
time under the provisions of the Act shall be strictly followed
while scrutinizing the plan of proposals submitted by the applicant.
(2) Provision of MP Bhumi Vikas Niyam regarding development of land/planning
permission should also be taken into the consideration.
(B) Procedure to obtain the proposals of the Development Plan (Proposed
Landuse)
Following documents are required for obtaining, proposals of Development
Plan on the land question under the provision of Rule 49(3) MP Bhumi
Vikas Niyam 1984.
(1) Described application form
(2) Original Khasra of the land in question showing no. of the land
in question and adjoining Khasra upto 200 mets. The land applied
for shall be shown in red.
(3) Latest Khasra Panchsala and Khasra Khatauni record.
(4) Registry of the land namantaran shall be accompanied with application,
if required.
(5) The application of the above shall be submitted by the owner
of the land in question only.
